In today’s legal environment, arbitration, adjudication and mediation often supplement traditional litigation as preferred mechanisms for the resolution of disputes confronting our clients. While arbitration, adjudication and mediation are sometimes encompassed within the concept of Alternative Dispute Resolution, there are several instances where contractual or other legal requirements of disputes make these processes the only means by which claims can be formally asserted and resolved. In other instances, however, clients may have the option of choosing how to most effectively press and economically resolve disputes that have arisen.
